Work accident compensation claim – Amputation injury

In this serious work accident compensation claim, Ken represented his client and was successful in securing compensation.

An initial ruling in the County Court went against his client, but Ken believed that this was an unjust decision and took the accident claim to the Court of Appeal. Here, he secured a decision in favour of his client and the award. The Judges ruled that the employer had not taken sufficient steps to ensure that Ken’s client had been provided with suitable equipment for the job, and that they had failed to carry out a risk assessment before his client began working.

Ken’s client had been injured in a work accident when he was using a power saw. He was provided with the saw by his supervisor and was cutting a long length of board on a temporary bench. As he carried out the cut, the board jerked and propelled his client’s hand into the blade, causing severe injuries to his hand and amputations to several fingers and his thumb.

He remains handicapped and at a disadvantage in the labour market.
