Work accident compensation claim – Crushing injury from falling objects

This accident at work happened as the result of the client’s employer failing to ensure staff were correctly trained and that items in the workplace were correctly and safely stored. Kevin’s client was injured when he was moving a heavy piece of equipment. As he did so a number of objects stacked in a rack behind the equipment, and totalling about a tonne in weight, fell over and crushed his foot.

The injury to Kevin’s client included several fractures to his foot and he was unable to work for some considerable time.

Kevin fought this case on the grounds that the employer had breached their duty to ensure his client was provided with a safe working environment and safe and competent fellow employees. Contrary to the Workplace (Health, Safety and Welfare) Regulations 1992, the employer had failed to take suitable and effective measures to prevent Kevin’s client from being struck by falling objects.

Kevin was able to negotiate substantial work accident compensation for his client, which included a sum for the loss of earnings during his recovery.

Work accident compensation claim – Manual handling injury

Kevin was asked to represent this client in claiming accident compensation for an injury he suffered in an accident at work. With the help of a colleague, Kevin’s client was attempting to lift a box out of a machine during essential maintenance. The lift was not only difficult because the box was large and heavy, but the action to manoeuvre it out was awkward. Kevin’s client had to stand on the machine and reach down, lifting the box from below foot level.

As he lifted the box, he felt a popping sensation in his back and was immediately in great pain. This was an accident at work that could have been easily avoided by providing a mechanical lifting hoist and the employer was in clear breach of the Manual Handling Regulations. These provide clear guidelines on the weight restrictions that apply and the type and frequency of manual handling training required to ensure the risk to employees is minimised if not entirely removed.

The defendant refused to accept liability for his client’s injury, despite there being several witnesses to this accident at work. When they made a derisory offer, Kevin stood firm and obtained more than four times their original offer in accident compensation.

Occupational disease compensation claim – Dermatitis

Kevin’s client in this occupational disease claim had developed dermatitis when her employer had introduced a new hand lotion. This was a much purer alcohol gel, more abrasive than the one previously provided, and users should have been advised on how it should have been used, how much should be used and that hands needed to be moisturised after the lotion was used.

Kevin’s client developed occupational dermatitis on both hands and has been left with a lifetime vulnerability to sensitivity to other chemicals. Had proper training been provided, and essential patch testing carried out before the product was introduced, it would have been known that there was a high risk of injury such as that suffered by Kevin’s client. Her injury could have easily been avoided had these simple precautions been followed.

The employer’s actions were a clear breach of the Control of Substances Hazardous to Health Regulations (COSHH) and given the long-term debilitating effects on his client, Kevin was determined to secure substantial compensation, which he was able to do.
