Work accident compensation claim

Working in a food preparation area, our client was injured in an accident at work. Due to the lack of space between work areas, our client received a severe stab wound to his arm from another employee. The injury when healed, left him with extensive scarring. Laura fought this accident at work claim for compensation on the grounds that the second employee had been negligent but that the employer had also failed to provide a safe working environment.

The defendant’s insurers refused to negotiate a settlement, so Laura was forced to issue court proceedings. However, prior to the trial she was able to negotiate an acceptable sum in accident at work compensation.

Work accident compensation claim

Laura fought a claim for this client on the grounds that the Provision and Use of Work Equipment Regulations 1998 had been breached by his employer.

He had been asked to carry out a task that required him to use a piece of equipment that he had not used previously. It was set up for him (but it didn’t operate as expected) and caused a serious injury to his hand, arm and shoulder. Our client’s injuries required surgery and extensive physiotherapy, and he was unable to return to work for several months.

The defendant’s insurers refused to negotiate and Laura was forced to issue court proceedings. Despite repeated attempts to negotiate, it was only at the steps of the court that the other side eventually offered an acceptable sum in accident at work compensation.

Accident compensation claim for assault at work

A railway worker, our client was seriously assaulted by a group of youths who attacked him at a station, pushing him to the ground and kicking him. As he fell, our client landed heavily on his arm and suffered extensive injuries, which required immediate treatment. It soon became apparent that his injury was extensive and the assault at work has left him with disability in one arm. He continues to suffer ongoing pain and numbness.

(It was argued that his employers failed to provide him with conflict training). His employers admitted liability for his injuries and (as a result of his ongoing symptoms and potential effect on his ability to carry out his job in the future) Laura was able to negotiate substantial assault at work compensation for our client.
