Work accident compensation claim – Slip, trip and fall

Lynn represented this client who suffered a work accident when using a stepladder in a confined space. The cupboard was extremely full and the top shelf was only accessible by use of the stepladder. On the day of the accident, Lynn’s client stepped down from the ladder, she lost her footing and fell, landing heavily on the floor. She suffered sprains and ligament damage to both ankles and also an injury to her inner ear.

Lynn was forced to issue court proceedings to bring this accident compensation claim to a conclusion. The District Judge found for Lynn’s client, awarding work accident compensation.

The Judge found that her employer had breached the working at height regulations and breached their duty of care to provide suitable work equipment. Evidence provided at the trial confirmed that following the accident, a risk assessment had been carried out. This led to the decision to remove some contents so that the top shelf could be removed, as had been the case in some other cupboards in the workplace.

Work accident compensation claim – Manual lifting of patients

This client developed pain in the joints on both sides of her neck, and pain in both shoulders during the course of her work. She was employed as a support care worker and her duties involved frequently working with patients with challenging behaviour, including physically lifting and restraining them when necessary. Over time, this put a strain on her neck and shoulders.

Some locations provided a hoist to help with lifting patients, some did not. However, Lynn’s client was not trained in the use of hoists and frequently there were insufficient numbers of staff to assist her when required.

Lynn’s client received several courses of medication, acupuncture and physiotherapy, including cortisone injections, which provided some relief but no permanent resolution. Despite a letter from her GP to her employer, advising that she could no longer work with patients with challenging behaviour, no change was made to her duties.

Lynn brought this work accident compensation claim on the basis of breaches of the Workplace (Health, Safety and Welfare) Regulations 1992 and although it was necessary to issue court proceedings, she was able to negotiate substantial accident compensation for her client.

Work accident compensation claim – Manual lifting of patients

Lynn was able to negotiate an acceptable settlement for work accident compensation in this claim without the need to issue court proceedings. Her client’s employer had breached the Manual Handling Operations Regulations 1992, causing risk of injury to her client.

Her client was a nursing assistant and was asked to assist a staff nurse in mobilising a patient using physical intervention techniques, which were included in the care plan for the patient.

Normal procedure for these techniques requires that 4 members of staff are involved, but at the time of the accident at work, Lynn’s client was asked to assist with just one other staff member. The patient in question was detained under the Mental Health Act and would not co-operate, forcing the staff to physically support him for some time.

During the handling of this patient, Lynn’s client suffered severe strain to her lower back with additional injuries to her spine. Since her accident at work, the care plan for this patient has been amended to remove the use of physical intervention. Had a risk assessment been carried out for the specific circumstances, this work accident would have been avoided.
