Work accident compensation – hit by falling object
Michael’s client was struck on the shoulder by a heavy object that fell as a result of defective lifting gear. Although he was offered alternative work with his employer, none of them was suitable for the client, either because of the injuries sustained in the accident at work, or because he did not hold the required skills for the new role.
Eventually, the client was retired on ill health grounds, though he has since found alternative, suitable employment.
Michael was forced to issue proceedings in order to bring the other side to the negotiating table. However, a few days before trial, they made an increased offer in accident at work compensation. Michael advised the client to accept which he did. The compensation included a sum for loss of earnings in a less physical job.

Michael’s client had suffered a serious injury to his hand in an accident at work. The client was employed as a machinist and had completed a manoeuvre to cut a piece of timber. Although he returned the blade to its safety position, as he removed the wood, the blade broke lose, swung down and caught the back of his hand, severing his finger.
His employer, the defendant, admitted liability for this accident at work. Michael negotiated a settlement of almost £50,000 on the grounds that there had been several breaches of the workplace regulations. In particular, the client’s employer had breached the Provision and Use of Work Equipment Regulations 1998, by their failure to maintain work equipment in efficient working order and in good repair.
