Work accident compensation claim – Slip, trip and fall injury
Employed in the educational profession, Samantha’s client had been injured in an accident at work when she slipped on a wet floor. Despite several complaints by colleagues in the weeks prior to her accident, the employers had taken no action to ensure this particular area did not present a hazard. As she was walking along the corridor, she lost her footing on the wet floor, lost her balance and fell forwards, landing in a heap with her neck and head twisted at an awkward angle.
The immediate pain in her head and neck was excruciating and she felt sick. When her symptoms did not subside, Samantha’s client sought medical help at her local A&E department. Although no breaks were detected, the client was unable to sleep and felt constantly dizzy and nauseous.
Further examinations confirmed that Samantha’s client would be unlikely to make a full recovery. She was advised that she would be unable to return to work, particularly that which she had enjoyed until her accident at work.
This was an extremely complex case, requiring detailed medical reports over time. Samantha was forced to issue court proceedings following two derisory offers of accident at work compensation from the defendant’s insurers. This client has sought Samantha’s compensation claim advice when her husband was killed in a tragically fatal accident at work. He had suffered traumatic asphyxia and compressive chest and abdominal injuries causing death within a very short time.
The trial was moved to the High Court in London where the judge found that the accident had occurred as a result of a misunderstanding by the deceased’s colleague. The deceased was not to blame in any way for his own death. Following this decision, the defendant made an offer outside the court of over £300,000 in accident at work compensation, which Samantha’s client accepted.
