Successful work accident compensation claims

Here is just a small sample of the successful compensation claims which Tristram has been involved in.

Accident compensation claim - Occupier’s liability – Attacked by animals

Owners of land have a duty to ensure that visitors are protected by providing a safe environment. When livestock is present, the owner must ensure that if circumstances exist that may place visitors at a greater risk than would normally be expected, signs should be erected to warn visitors of this risk. Normally there is little risk of cows attacking walkers, but when they have calves alongside them, they can become protective and aggressive.

Tristram’s client in this accident compensation claim was walking along a familiar route with his wife and dogs when he was attacked by cows and trampled. He suffered chest injuries and a serious fracture to his wrist, which ultimately led to his inability to return to work. He has had to undergo several operations to his wrist and the likelihood of several more is high.

Tristram won this claim for compensation on the grounds that the farmer should have erected signs warning that calves were present and by not doing so had failed to comply with the HSE hazard guidance on keeping cattle in fields with public access. Tristram secured over a quarter of a million pounds in compensation for his injuries and substantial future loss of earnings.

Work accident compensation claim – Manual handling injury

Tristram fought an accident at work compensation claim for Mr Hartley when he was forced to take early retirement after injuring his back at work. Mr Hartley was routinely expected to move heavy objects as part of his duties, but on the day of his accident, no risk assessment had been carried out on this particular task. As he was lifting the equipment, he fell causing a slipped disc in his back and damage to his sciatic nerve.

Mr Hartley was in such pain that he decided to seek private treatment rather than wait for the operation on the NHS. When Tristram was able to secure substantial compensation for this accident at work, it was a huge relief to Mr Hartley in view of the cost of his private healthcare.

Tristram had been forced to issue court proceedings against Mr Hartley’s employer but was able to negotiate an acceptable settlement before the trial date. The accident compensation was awarded for Mr Hartley’s manual handling injuries and in compensation for future lost earnings, as he is unlikely to secure alternative work due to his ongoing condition.
