Work accident compensation claim – Manual handling injury

William’s client was a service technician employed to maintain and repair rolling stock and engines on the railways. On the day of his work accident, his employer had failed to provide specific equipment to assist with a particular task and he was forced to use a spanner, which had become a regular alternative when the correct equipment was not available.

Using the spanner required considerably more force than the correct equipment and as he tried to undertake the task, William’s client felt a pain in his shoulder. When he attended hospital and received an x-ray, it was confirmed that he had strained ligaments. He was unable to return to work for some time and was in considerable pain.

Since the accident, his employers have taken steps to ensure the correct equipment will be provided but their negligent actions constituted a breach of the Management Regulations and the Manual Handling Regulations, amongst others.

William was able to secure over £20,000 in work accident compensation without the need to go to trial, but not before he had advised his client to reject two earlier offers which he did not feel adequately compensated his client for his injuries.

Work accident compensation claim – Crushing injury to hand

A train driver, William’s client in this work accident compensation claim, had had his hand crushed in an accident that took place whilst he was driving the train. He had been attempting to open a window in his cab which was hot. The window was difficult to open and as he pulled it down, the air pressure in the cab changed and the door giving access to the rest of the train suddenly flew open, crushing his hand where he had placed it on the door jam to steady himself.

Work accident compensation claim – Assault at work

William’s client suffered injury to her foot, hip and knee when she was assaulted by the defendant when she was working as a paramedic. With a colleague, she had been attending a patient in a public area. The defendant was a friend of the patient and attempted initially to prevent William’s client from tending the patient. When the situation became confrontational, his client and her colleague decided to call for police assistance and leave the immediate vicinity to await their arrival.

As they left the scene, the defendant then followed William’s client and accused her of leaving her patient, becoming both verbally and physically abusive. As she tried to free herself from the defendant’s grasp, she braced herself and in doing so, twisted her leg causing a serious injury to her knee.

Despite the fact that the defendant was cautioned by the police for being drunk and disorderly, he refused to negotiate a settlement, and William was forced to issue court proceedings. However, before the trial date, satisfactory settlement terms were agreed and William was able to secure a five figure sum in work accident compensation for his client.
