Accident claim brought after second accident at work aggravates neck injury

Sam won a client’s accident claim when he injured his neck and back as a result of two accidents at work in a boiler house.

The first injury occurred whilst assisting in the certification of a boiler. The insurance inspector had informed him that the blow down pipe on the boiler would need to be removed for the boiler to be certified.

Our client was required to climb underneath a boiler in order to gain access. The area was so confined that he had to squeeze in on his back with a clearance of just a few inches. He could not turn over and had to work with his hands raised behind his head. He suffered a neck injury as a result. He reported the accident to his manager but an accident report was not completed.

His neck injury was further aggravated in a second accident when he was required to tidy the boiler house by moving 25kg bags of salt and water treatment tubs holding 25 litres of water. Our client had not undergone any manual handling training nor was he put on any restrictions of duties between the first and second accident.

As he was carrying out this task he felt a severe pain in the neck and back and was unable to return to work.

Liability was denied by his employer and his colleagues would not assist. The medical evidence showed a huge difference of opinion. The defendant’s opinion was that there was a six month exacerbation of a pre-existing condition, whilst in our opinion, there was five to seven years exacerbation based on our medical evidence. Sam secured a settlement of £30,000 for the client's injuries.

Storekeeper wins accident claim compensation

Sam represented a client who worked as a storekeeper for an NHS Trust when he injured his shoulder clearing out a storeroom ready for a refit. The client was asked to empty shelves in the stores and as he lifted a box by the plastic heat-crimped tie secured around it, the tie snapped causing the box to fall to the floor and the contents to spill out.

Our client lost his balance as the box fell and he tried to avoid falling into the cage being used to transfer the boxes. As he fell, his shoulder struck the corner of the shelving units and he twisted his back. He sustained a tear to the rotator cuff of his shoulder as a result of the fall. The movement in his shoulder has been restricted as a result and he experiences ongoing pain and discomfort.

He was forced to retire early as a result of the injury. The NHS Trust admitted liability but suggested a ridiculous amount of contributory negligence. Sam secured over £35,000 for the client.
