Woman receives road traffic compensation for shoulder and other injuries

Travelling to work one morning, our client was negotiating a bend when, without warning, her car was involved in a car accident and was struck in the side by a transit van that had reversed from a driveway on the bend.

Our specialist road accident compensation lawyers represented this client in making a claim for compensation. Despite the defendant driving whilst uninsured, we were able to bring this claim for car accident compensation through the Motor Insurers Bureau. We were able to negotiate several thousand pounds in road accident compensation for our client's injury, plus an additional direct payment for the second operation.

Sideways collision by transit van

The driver of the transit van had reversed from a side driveway into oncoming traffic without taking appropriate measures to ensure his exit was clear.

Injuries from the road traffic accident

As the collision occurred without warning, our client was unable to brace herself before the impact and was shaken around, causing injuries to her arm and shoulder.

Immediately following this road accident, she felt pain in her shoulder and had difficulty lifting her arm which felt heavy.

During the night, the symptoms worsened and although she attended work the next day was unable to carry out her duties which involved an element of manual handling.

Consequences of road traffic injuries

Our client was fortunate in that her employer was able to make temporary allowances for the fact that she was unable to lift objects and allowed her to work on light duties. However, when her symptoms failed to improve she made several visits to her GP and was eventually referred to a specialist.

She underwent several X-rays, an ultrasound scan and had nerve conduction studies carried out and she was eventually diagnosed as suffering with a frozen shoulder. It took 2 surgical procedures over several months, followed by a series of physiotherapy sessions before she eventually began to improve.
