Compensation For Injuries At Work Resulting From Breaches of Regulations

An accident claim for personal injury compensation for an injury at work has been won against the Leeds Teaching Hospitals NHS Trust. Our client worked in an administration department where she was required to retrieve stationery from pigeonholes situated high on a wall, above a desk. Our client asked us to represent her in bringing this injury at work compensation claim as she suffered back injuries at work and the aggravation of a pre-existing migraine condition, which have left her with ongoing symptoms.

The defendants were aware that employees were having difficulty reaching the stationery and that they frequently had to climb from a footstool on to the desk to reach them. The workplace accident occurred whilst our client, who at only 4 feet 8 inches tall had particular difficulty, was climbing down from the desk to the footstool. She lost her footing and fell heavily on to the floor.

She did not experience immediate pain, and was able to carry on working through the day. However, the next day she noticed that her back was swollen and painful and visited her GP who confirmed that she had suffered back injuries at work. Following the workplace accident, it took several weeks for the work injury to improve sufficiently for her to return to work.

The Judge found for our client and agreed that this work related accident had occurred because of several breaches of regulations.

The defendants denied liability for her back injury at work throughout the case and our specialist personal injury lawyers were forced to issue court proceedings. Their continued refusal to negotiate a settlement for work injury compensation meant the case had to proceed to trial.

The Judge accepted that the use of the footstool and desk was common practice, which had been known by the employer, and awarded our client £2,500 in compensation for her work related accident.
