Accident compensation for injury in fork lift truck accident

Although the defendant, the employer, admitted some liability for our client's injuries following this forklift truck accident, our specialist accident at work lawyers were forced to issue court proceedings in order to obtain a satisfactory sum in accident compensation. However, some time before the trial date, they were able to negotiate an acceptable sum of almost £100,000 in work accident compensation.

Breaching the employer's duty of care

Our accident compensation lawyers argued that this serious accident had arisen because of breaches to several regulations that apply to the workplace. These included breaches of the Management of Health and Safety at Work Regulations, 1999.

The defendant had been negligent in allowing pedestrians and forklift trucks to share the same narrow and congested aisle in the workplace, and failing to provide separate pathways. In addition, the forklift truck was in a poor state of repair and was not fitted with a functioning reversing alarm, which would have warned our client of its movements.

Work accident

Our client had been standing in the pathway discussing work issues with a colleague and when he turned to walk away, was struck by the forklift truck. It knocked him to the ground and ran over him.

Fork lift truck injury

Our client's injuries following this accident at work were severe. He was immediately taken to hospital, where he was examined, x-rayed, and underwent emergency surgery to repair the worst of his injuries.

His injuries included several fractures in his leg, crushing to muscles in his leg, and a broken pelvis. Although he has made a good recovery from some of these injuries, he has been left with mobility issues and will continue to be at a disadvantage in the labour market.

An element of his substantial compensation will be to offset his loss of earnings through being unable to secure employment of similar income.
