Government announces insurance fund of last resort for mesothelioma victims

A support scheme for mesothelioma sufferers and their families has been announced today. The Department for Work and Pensions has responded to a consultation about establishing an Employers' Liability Insurance Bureau to provide compensation for injured workers when all efforts to trace their employer's insurer have failed. However, the scheme will only be open to victims of mesothelioma who are diagnosed from today, 25th July 2012.

Thompsons Solicitors, who have been campaigning alongside Trade Unions and Asbestos Victims Support Groups, for an Employers' Liability Insurance Bureau, regard the announcement as a missed opportunity.

Although welcoming the additional support for some mesothelioma sufferers, Thompsons criticised the scheme for failing to compensate all workers injured through their employers negligence when the insurer cannot be traced. Many mesothelioma victims will also be left unprotected because they were diagnosed before the announcement was made.

The scheme will not protect sufferers of other types of asbestos-related illness or other latent industrial diseases such as bladder cancer, which can be life-threatening and take many years to develop.

Who will be eligible for compensation from the scheme?

Whilst full details of the scheme are yet to be published, the aim is to provide compensation for victims of mesothelioma who have developed this fatal disease through exposure to asbestos at work, but whose employer has gone out of business and their insurance company cannot be traced.

Anyone diagnosed with mesothelioma on or after 25 July 2012, will be eligible, but those diagnosed prior to that date will not. Sufferers of asbestos-related lung cancer, pleural thickening and asbestosis, which are disabling conditions and can be fatal, are also excluded from the scheme

Tom Jones, partner at Thompson Solicitors, said: "While we welcome any initiative to provide compensation for mesothelioma sufferers who cannot trace the liability insurers of their former employers, the government's announcement is a sop to the insurance industry.

"By limiting the scheme to mesothelioma, 50% of asbestos victims - those with asbestosis, pleural thickening and asbestos-related lung cancer - will remain uncompensated.

"The government's friends in the insurance industry are once again reaping the rewards of their donations to the Tory party while innocent victims are short-changed."
