HGV driver awarded road traffic accident compensation

An HGV driver for many years, our client asked for our advice on making an accident compensation claim after he was injured in a road traffic accident.

Although the other driver, the defendant, admitted liability, it was necessary for our specialist road accident lawyers to issue court proceedings before they were able to successfully negotiate an acceptable level of personal injury compensation for our client.

However, shortly before the trial date, we were able to secure £18,000 in road traffic accident compensation for our client’s injuries and his reduced income as a result of his wanting to stop driving HGV’s.

Road traffic accident

At the time of the road accident, our client had been stationary in his vehicle at a set of traffic lights. The traffic lights controlled a busy junction with several lanes of traffic diverging onto a number of A-level roads.

To his left was another vehicle in a lane that led off to the left, and our client was in the lane heading straight ahead. Behind the vehicle to his left was a second vehicle which, when the lights turned green and the HGV drove off to the left, tried to undertake our client and cut in front of him into the lane for traffic going straight ahead.

Unfortunately, the driver did not have sufficient time or space to complete this dangerous, negligent manoeuvre and he collided with the nearside of our client's vehicle, causing it to stop suddenly and violently. Other vehicles at the junction also had to swerve to avoid both vehicles.

Accident injuries suffered in the road traffic accident

As our client's vehicle was jolted around, our client hit his head on the door, immediately suffering considerable pain in his neck, and the affects of the accident left him feeling light headed.

Although he was able to return to his depot immediately following the road traffic accident, it was clear that he was not well and he was immediately sent to hospital in an ambulance, where he was diagnosed with concussion and whiplash injuries.

Our client’s physical injuries did heal in time but the long-term effects of the road traffic accident were that he felt unable to return to driving HGV’s, and subsequently sought other employment.
