Injured at work by object falling from a height

Clear Answers' specialist personal injury lawyers, Thompsons Solicitors have recently won compensation in an accident claim for a woman injured at work by an object falling from a height.

The claimant worked as a cook supervisor at a school. She was in a store room, standing on a ladder lifting boxes onto the top shelf of some racking when a fluorescent strip-light cover fell off and hit her on the head and shoulder.

The Judge found that that she had dislodged the light cover causing it to fall on her head.

However we argued for our client that the equipment was still maintained in an unsafe state. This was because the light fitting had fallen when knocked and hence was unsafe: in this instance the lights were not safely clipped.

The Judge found there was a breach of the relevant law. The defendant fitted the light cover in the store room where it was likely to be knocked due to employees putting items on shelving. They should have taken suitable measures to fit a more substantial light fitting.

They Judge split the blame two - thirds against the employer and one third against the employee for striking the light cover.
