Accident compensation awarded to manager in manual handling accident

As a senior manager, our client worked in a large office in a role which did not involve any physical duties. However, during an office move, and despite receiving no training in the correct manual handling procedures, he was instructed by his line manager to assist in moving a box of confidential material. As he lifted the box, he felt a sudden sharp pain in his back.

Personal injury compensation claim advice

Medical examination following this work related injury confirmed that he had received a soft tissue back injury and that the accident had accelerated a pre-existing condition by several years.

Breach of Manual Handling Regulations 1992

His employer had requested that he undertake this manual handling operation without carrying out any adequate risk assessment, exposing him to a foreseeable risk of injury. Together with the lack of appropriate manual handling training, these failures to protect our client from personal injury were in breach of the Manual Handling Regulations 1992.

The defendant admitted liability for this accident at work but refused to negotiate an acceptable settlement for accident at work compensation.
