Accident compensation for client who suffered a permanent injury to her arm

Visually impaired and registered blind, our client in this tripping accident compensation claim had made several complaints to her local council regarding potholes outside her home.

No action was taken until after her accident, and even then, they denied any responsibility when she wrote to them again to request that they be repaired to prevent further injury to herself or neighbours.

The movement in her arm is much restricted, leaving her unable to carry out even some small tasks around the home, having to rely much more on her family and friends.

Breach of statutory duty and negligence

The local council has a responsibility to inspect all areas and identify and repair those hazards that are defective and causing a hazard. By failing to repair this defect, they had breached the Highways Act 1980.
