Personal injury compensation for train passenger suffering smoke inhalation

Travelling on a deserted train, our client was horrified when it suddenly stopped and she could see that the train was on fire. She asked for our expert legal advice on bringing a claim for personal injury compensation for the injuries and trauma she suffered during this horrifying experience. Our specialist personal injury lawyers were able to negotiate several thousands of pounds in compensation

Lone passenger

Our client was the only passenger in her carriage when she spotted smoke and flames coming from beneath one of the carriage doors. Despite her best efforts to open the doors, and pull the emergency handle, she was unable to escape. The driver eventually arrived to free her, but she was alone for some time and terrified, fearing she would not be able to escape.

Treatment for smoke inhalation

When the driver arrived to lead her off the train, she was unable at first to see him at the end of the carriage through the thick smoke. To reach safety, they walked along the track where she received treatment for smoke inhalation before going to hospital. The traumatic experience has left her suffering nightmares and sleepless nights.

Claiming compensation for failures by the train operator

Our personal injury lawyers brought this claim for compensation against the train operator who had failed to ensure the train was safe for passengers by failing to maintain or service the train adequately, and in particular failing to ensure that there was an effective emergency door release.
