Accident at work leaves man with permanent injury and disability

After tripping and falling and suffering significant injuries, our client asked for our legal advice in bringing an accident at work compensation claim.

Although the defendant’s insurers admitted liability, it became necessary for our specialist work accident lawyers to issue court proceedings. However, having secured a substantial interim payment to assist with our client’s immediate financial needs, we continued robust negotiation with the defendant’s insurers. After advising our client to reject an initial offer, we were able to agree satisfactory terms before the date of the trial. The six figure sum we secured was more than twice the original offer and was placed in a Trust Fund.

It is unlikely that our client will be able to return to paid employment and it was therefore vital that the compensation awarded was sufficient to cover his lost future income, as well as providing sufficient funds to cater for his long-term accommodation and future medical treatment.

Tripped and fell at work

Our client suffered his injury because he tripped on banding that had been discarded on the walkway of his place of work. This is a well-known hazard and has caused many accidents at work. Although many injuries caused by this type of tripping accident can be relatively minor, our client fell heavily on his knee and suffered serious injuries to his knee and his foot.

He was immediately taken to hospital where examination confirmed that he had suffered a significant fracture dislocation to his knee, and that he had completely torn a nerve that had caused the injury to his foot, leaving it permanently partially paralysed.

Under heavy sedation, his knee was returned to its correct position but he has been advised that at some point he will require replacement knee surgery.

Our client has become extremely dependent upon family and friends for certain activities and will require substantial changes to his accommodation to allow him to continue to live independently.
