Vibration white finger compensation for decades of negligent exposure

Since the age of 16, our client had worked for the same multi-national manufacturer, until he was forced to accept redundancy due to the development of vibration white finger, several years prior to the age at which he had planned to retire. This was a breach of the Management of Health and Safety at Work Regulations as well as the Control of Vibration at Work Regulations, which were implemented to provide protection to employees because of the known risks when using vibrating tools.

A risk assessment would have identified several actions which could have reduced the risk to our client, including arranging shift patterns to rotate the use of these tools for extended periods. It would also have highlighted the need to provide information to our client about how to use the tools to minimise the potential risk caused by their use.

Symptoms of HAVS or vibration white finger

Symptoms can include tingling and numbness in fingers and hands, which can disappear during warmer weather. Frequently, fingers become white, with a loss of all feeling in them.

Concern for our client's condition was raised during a routine visit to the occupational health nurse, and it was confirmed that he was suffering from vibration white finger when he was referred to a specialist.
