Mesothelioma compensation awarded to builder during his lifetime

Negligently exposed to asbestos dust as a young man

A builder for most of his working life, our client had worked for several employers, but it had been his first employer who had routinely exposed him to high levels of asbestos dust as a consequence of cutting asbestolux board.

During the cutting of the asbestolux, huge clouds of dust would be created, covering our client from head to toe, resulting in him breathing the deadly asbestos dust.

Our client would then be required to sweep up the asbestolux debris, causing dust to be thrown into the air. Using a dustpan and brush to gather the smaller debris, he inhaled the asbestos fibres at close quarters.

No warnings on the danger of asbestos-related diseases

In the mid 1970's the hazards of inhaling asbestos dust, and the risk of developing an asbestos-related disease, were well known to employers. Our client was never warned about these dangers, nor was he provided with protective equipment such as masks, exhaust ventilation or other breathing equipment.

Symptoms of an asbestos-related disease

Decades after his negligent exposure to asbestos dust, our client had maintained a healthy fitness regime. When a pain he developed in his side did not improve, he went to see his GP and then for a CT scan. Following surgery, a further scan revealed fluid in his lungs and he underwent a biopsy. Sadly, this revealed that he was suffering from the fatal asbestos-related disease, mesothelioma.

Breaches of regulations

Not only had our client's employer breached several health and safety regulations, they had been negligent by exposing our client to a major risk of fatal injury through the inhalation of asbestos dust, without adequate protection or warning of the risks.

In particular, they had breached the Asbestos Regulations 1931 and 1969, and the Factories Acts 1937 and 1961 by failing, amongst other failings, to keep the premises in a clean state and free of asbestos dust and fibres.
