Travel accidents and travel illness abroad

Clear Answers' solicitors are sympathetic to your plight and 100 per cent dedicated to obtaining the maximum amount of travel accident compensation in the shortest possible timeframe. We aim to make the process as simple and as straightforward as possible for all our clients and have an impressive track record when it comes to travel accident compensation claims.

No matter how complex the case seems to you, we will be able to provide you with expert travel accident advice that is straight forward and in plain English. A personal injury lawyer who specialises in travel accident compensation claims, will be there every step of the way throughout your claim to answer any questions that you may have and we are committed to keeping you informed throughout the whole legal process.

Most travel accident compensation claims are brought using Package Travel, Package Holidays and Package Tour Regulations 1992. Package holiday tour operators have strict responsibilities under the Act and the Regulations remove the need to prove negligence.

For example, if your travel illness is due to food poisoning as a result of a meal you've had in your hotel, or your travel accident is as a result of a bed collapsing causing you injury, and in many other circumstances, you could be entitled to damages. The travel accident compensation claim can be brought against the tour company direct in the English or Welsh Courts.

Different rules may apply in other countries if your claim is pursued outside the Courts of England and Wales. Before any costs are incurred, we will provide appropriate advice and each case will be reviewed on its own merits.

Road traffic accidents abroad

Clear Answers' solicitors can offer expert legal advice if you have been involved in a car accident abroad. You may have the right to seek road traffic accident compensation if another party can be identified who was responsible for the accident.

In some countries, as a pre-requisite to bringing a compensation claim for road traffic accident compensation, you must seek immediate medical attention and report all of the injuries that are known to you at that time. You should also report the road traffic accident to the police, retaining all relevant paperwork.

If you subsequently become aware of injuries that were not obvious at the time, you should contact the medical advisors and the police to update them as to the developments. There are many instances in which this might occur. For example, not all whiplash style injuries are immediately apparent. Some develop overnight, or even over a period of a few days after the road accident.

In addition, even if the physical injuries are immediately obvious at the time of the accident, some psychological injuries are often overlooked because the medical advisors tend to concentrate, for understandable reasons, on the more obvious physical injuries. In these types of situations, it is important to report the symptoms to the appropriate authorities as soon as you become aware of them.

If you have been involved in any road traffic accident abroad, we may be able to help you. Whether you were a driver or a passenger, in a car, taxi, coach, or bus, call us on 0800 783 9019 for expert legal advice about whether you can make a road traffic accident compensation claim.

What to do if you have a travel accident

Travel accidents abroad can happen at anytime and can be extremely daunting, as you find yourself in a foreign country having to organise medical assistance, without necessarily being able to speak the language. If your travel accident happens as a result of inadequate and substandard facilities whilst on a package holiday, then it is advisable to first submit a complaint about the travel accident to the management of the premises on which the accident occurred.

Always keep a record of how the travel accident occurred, and take photographs if possible. Take the names and home addresses of any witnesses to your travel accident and also keep receipts for any expenses incurred as a result of your travel accident or travel illness. These items may prove useful throughout the travel accident compensation claim process.

Travel accident claims we have dealt with

Clear Answers' solicitors have an impressive track record when it comes to dealing with travel accident compensation claims. Our solicitors have successfully represented clients that have suffered accidents whilst on holiday in the UK as well as holidays abroad.

One such case involved Mr Jones whose travel accident occurred when staying in the Hotel Negresco Princess whilst on holiday on the Costa Dorada in Spain.

The room that Mr Jones and his family were provided with for their package holiday was cramped and comprised of two single beds with a folding camp bed situated in-between the two. Mr Jones and his family had aired their grievances to the hotel management. However, they were denied a new hotel room or even a new bed in place of the existing one.

Mr Jones' holiday accident occurred as a result of the folding camp bed. In order to get in and out of bed he needed to sit and carefully shuffle the length of it. Mr Jones' accident happened as he was in the middle of doing this with the bed collapsing underneath his weight. Mr Jones fell through the bed with his back impacting on the floor.

The holiday company were found to be at fault for the holiday accident and Mr Jones was awarded travel accident damages.

Another client that our solicitors have successfully represented was Charlotte Gotte from Keighley. Miss Gotte's holiday accident occurred whilst she was on holiday at Centre Parcs in Sherwood Forest.

Miss Gotte, who was 12 at the time of her holiday accident, had only just arrived at Centre Parcs with her mother for a weekend break when her accident took place. The holiday accident occurred as Miss Gotte was handed a cup of tea in a café at the Parc. It was handed to her in a glass cup with a narrow handle. The glass heated up so quickly that she had to put the cup straight down and in the process, she spilt the tea all over her hand, badly scalding it.

Charlotte's mother, Mandy Gotte, said of her daughter's accident: "As well as causing severe pain, the incident ruined a weekend break that Charlotte had been looking forward to. She couldn't take part in any activities and had to have an arm in a sling. The most annoying thing was that all the other cafes on site, staff put drinks on a tray before handing them to the customers."
