Serious injury compensation claims

Here are just a very small sample of the range of cases which David undertakes.

Industrial disease compensation claim - Exposure to hazardous substance

David was heavily involved with an industrial disease compensation claim for a client who had been exposed to dangerous toxins whilst in the RAF. The MOD had strongly denied liability for our client's condition but after a long and tireless battle by the client, Andrew McDonald and David, which went all the way to the Court of Appeal, we won a groundbreaking decision after the Court dismissed the Ministry of Defence's case.

Many years after his exposure to a lethal cocktail of solvents, our client had been diagnosed as suffering from Multiple System Atrophy-P (MSAP), a Parkinsonian condition that affects the nervous system. There is no cure and he is now wheelchair bound, and virtually housebound during the winter months when his condition is made worse by the cold.

Amongst other arguments made by the MoD, their objection that it was time barred (outside the three year time limit for making a claim for compensation) was dismissed at an earlier hearing. The decision to allow people who develop neurological conditions in similar circumstances to pursue compensation claims against the MOD is a major victory.

Road Accident compensation claim - Amputations

Whilst loading shopping into his car one of our clients was struck by another vehicle. The force was such that it necessitated the surgical amputation of one of his legs. Prior to the accident the client had been very active and David was keen to ensure that the client's life was restored to normal as far as practicable. Fortunate to have the extensive support of his family, his client was nevertheless keen to be able to be as independent as possible.

Within weeks of the accident, David managed to secure a significant interim sum of compensation, a sum which provided for adaptations to the client's home. The sum was also used to provide the necessary care and assistance to the client and to get him mobile again. Further interim payments were secured by David, which provided his client with the funds to obtain suitable prosthesis and a vehicle adapted for his use.

Despite accepting liability for our client's serious injuries, the defendant and their insurer refused to negotiate an acceptable settlement. Through strong and determined negotiation David pursued them through mediation and was successful in securing a significant sum in road accident compensation. This will enable his client to obtain the necessary care, equipment and accommodation he will need for the rest of his life.

Work accident compensation claim - Manual handling injury

In the course of her employment in the NHS, David's client went to attend to a patient. On either side of the bed protective mattressing was laid on the ground to prevent the patient from falling and sustaining injury. His client had to step on one of these and as she did so it slipped. His client fell and landed sharply on her knee and injured her knee and back.

Liability was admitted. David advised his client to reject an initial derisory offer, but following detailed negotiations with the NHS, David was able to secure over £20,000 in work accident compensation for his client. This sum included compensation for his client's need to retire earlier than planned with a loss of earnings and pension

Road accident compensation claim - Rear-end shunt

Liability was admitted by the defendant in this road accident compensation claim. However, David's client suffered a tear in her rotator cuff which was only diagnosed when she did not make a full recovery within the expected timeframe for such an accident and injury.

Following this further diagnosis and appropriate treatment his client eventually made a full recovery.

Through detailed negotiations, David was able to secure fair compensation for his client which she was able to accept.

Fatal accident - Trip and fall at home

David represented the daughter of an elderly widow who had suffered a fall in her home, and who died from a heart attack as a result of her injuries. As a result of the fall she had suffered a fractured hip and wrist. The grandmother, who had been fit and well up until her accident, had tripped on a vacuum cleaner cable which was trailing across her living room floor after its use by a visiting heating engineer. She was taken to hospital but died the next day when pre-existing medical conditions were exacerbated by the fall and brought on the fatal heart attack.

The engineer had called at the deceased's home to carry out a service without a prior appointment, which meant that she had been unable to make arrangements for a suitable time or prepare herself for his visit.

The deceased's daughter wanted to bring this claim in order to highlight the risk to which her mother had been exposed by the practices operated by the engineering company. Their employee had entered her mother's home without appointment and his actions had resulted in the death of her mother in completely avoidable circumstances.

They continued to deny any liability for this fatal accident until David issued court proceedings. He was then able to negotiate a sum in compensation and extract an apology from the contractor to the deceased's family. More important than the compensation was the recognition that their actions had been responsible for her premature death.
