Successful accident compensation claims

Below are just a few examples of the many cases that Henrietta has dealt with and secured substantial accident compensation for victims of serious injury.

Serious injury compensation claim - Fatal accident

Henrietta represented the widow of a man who was killed as he emptied rubbish at his local recycling centre. She was able to secure a substantial sum in compensation for the loss of her much loved and devoted husband.

The deceased was emptying rubbish into the pit when the shovel of a vehicle being operated by one of the centre's employees, dropped onto him, crushing him between the shovel and a wall. He suffered serious chest and spinal injuries and despite extensive efforts by medical staff, he later died in hospital.

Amongst other failings, the operators of the centre had failed to ensure that vehicles and pedestrians could circulate safely at the site and were therefore in breach of the Occupiers Liability Act 1957, which requires them to ensure the safety of visitors to their premises.

Henrietta's client also suffered significant trauma as a result of her experience of the aftermath of the accident and the death of her husband.

The operators of the site admitted liability and Henrietta was able to secure an interim payment for her client, which provided some financial relief during the difficult period immediately after the loss of her husband's income. However, Henrietta was forced to issue court proceedings when the defendant's insurers refused to negotiate an acceptable settlement. After rejecting one offer, she was able to negotiate a realistic sum in compensation before the date of the trial.

Road accident compensation claim - Cycling accident

This client asked for Henrietta's compensation claim advice when she suffered serious injuries as a result of a cycling accident.

Her client was cycling to work in a cycle lane, intending to go forward at the junction. A lorry pulled left into her lane and turned left, knocking her from the bike and running over her, trapping her legs under the wheels.

Henrietta's client was a very experienced and frequent cyclist but will never be able to do so again. Her injuries were so severe, and included several fractures and degloving injuries that required extensive skin grafts, that she was in hospital for several months.

She was unable to return to work for some time and is left permanently disabled. This has affected not only her future employment potential but also her lifestyle and social activities. In the process of developing her career, her disabilities have rendered her unable to continue in her chosen profession.

Henrietta secured an interim payment for her client, which provided some financial support for her immediate care requirements. However, after rejecting several offers from the defendant's insurers, Henrietta was forced to issue court proceedings. Prior to the trial date, Henrietta was able to negotiate a six-figure sum in road accident compensation that was appropriate to the extent and long-term impact of her injuries.

Road accident compensation claim - Pedestrian accident, hit and run

An uninsured driver knocked down this client and left her lying unconscious in the road. She suffered multiple injuries, including a head injury, several fractures, including her pelvis, and many other injuries.

The defendant had been driving on the wrong side of the road without lights and as a result of his negligent driving, Henrietta's client has been left with permanent injuries that mean she is unlikely to be able to return to work. She also required significant alterations to her home to allow her to live as normal a life as possible.

Immediately after the hit and run accident, she underwent extensive surgery and has had to undergo many further procedures in the following years.

Although the police were able to trace the driver, as he was uninsured, Henrietta brought this claim against the Motor Insurers Bureau. Although she was forced to issue court proceedings in order to bring the claim to a successful conclusion, before the trial date, Henrietta was able to negotiate an appropriate seven-figure sum in road accident compensation. During the extended period of bringing this road accident claim, Henrietta was able to secure several interim payments that allowed her client and her family the ability to begin the alterations to their lifestyle and accommodation.

Work accident compensation claim

A maintenance worker on the railway, Henrietta represented this client when he was hit by a train whilst carrying out his routine duties. Although lookouts were usually posted at all times, her client was hit as a train left the station, having heard no warnings from either his team or the train driver.
He suffered significant injuries including a fractured skull, several fractures to his limbs, and a spinal fracture.

Following his discharge from hospital, where he had spent several months undergoing surgery and other treatments, Henrietta's client has been unable to return to work due to the debilitating effects of his injuries. In particular, his head injury has left him with difficulties with concentration and memory retention.

Fortunately, her client and his family were supported by an extended family in the immediate aftermath of the accident, but Henrietta fought to secure him the appropriate level of compensation that would allow him to move on with his life in as normal a way as possible.

Although the defendant had admitted liability early on during the claim process, they argued that her client was partially to blame for the accident, an argument strongly resisted by Henrietta on her client's behalf. Henrietta had rejected several unsatisfactory offers before being forced to issue court proceedings. She had been able to secure an interim payment, which had helped the family with their immediate needs, but shortly before the trial date, she had negotiated an acceptable sum, which her client accepted.
