Often it takes some considerable time for the long-term prognosis to be confirmed and Peter recognises how vital it is that all the medical details are known and understood before attempting to calculate the amount of accident compensation that should be sought.

Successful accident compensation claims

Road accident compensation claim – Motorbike accident

Peter acted on behalf of a motorcyclist who suffered serious spinal injuries in a road accident. He had been legitimately travelling at speed on a racing circuit that allowed members of the public to experience the circuit for themselves. His client came up behind another group of riders and after observing them for some time to ensure it was safe to pass them, began to close the gap to overtake. One of the group crossed in front of Peter’s client and caused him to move across to the far side. However, as the track was quite narrow and there was a steep drop at the far side, Peter’s client was unable to take avoiding action and the bikes collided and crashed.

Peter’s client was taken to hospital where he remained in intensive care for several weeks. He has suffered a broken neck and several vertebrae, as well as damage to his spinal column, and was told that surgery would not be able to correct or improve his injuries. However, the original prognosis that he would be unable to regain movement in his arms proved unfounded.

The other side’s insurers refused to negotiate an acceptable sum in accident compensation and Peter was forced to issue court proceedings. However, prior to the trial date, Peter was able to negotiate a six-figure sum in motorcycle accident compensation for his client, part of which was in compensation for congenial employment loss as well as his future loss of earnings. It will also provide suitable accommodation, care and facilities for his on-going needs and disabilities.

Work accident compensation claim – Hit by flying object

Whilst pursuing this serious accident at work, Peter negotiated two interim payments, which allowed his client to seek alternative suitable accommodation, and begin to receive the care he would need for the rest of his life.

Peter’s client was injured in a work accident when he was hit by a flying object, thrown forcefully in his direction when a piece of machinery exploded due to a faulty repair. He was hit in the leg and despite several operations to try to repair the damage, it was eventually necessary for his client to have his leg amputated.

Peter was forced to issue court proceedings when the other side refused to negotiate an acceptable settlement. However, before trial Peter was able to secure a seven-figure sum in accident compensation for his client’s injuries and ongoing disability, as well as the fact that his disability would mean he would be unlikely to work again.

Work accident compensation claim – Manual handling injury

This client’s employer had breached several regulations, including the Lifting Operations and Lifting Equipment Regulations 1998, when he allowed him to work alone on lifting some heavy products. The procedure required the use of a crane and Peter’s client was injured when he was trapped between two of the heavy products.

His employer was in breach as he allowed his employee to use a remote control box which was not fitted with a “dead mans peddle”. Because of this, the crane was accidentally operated before Peter’s client had moved to a safe area after securing the chains to the item to be moved. His employer had also allowed Peter’s client to work alone when the operation was a two-man operation and required a Banskman.

Peter’s client suffered significant and numerous injuries, including fractures of the pelvis and vertebra, plus serious internal injuries. His client’s employer admitted liability and Peter was able to secure a six-figure sum in work accident compensation.
