Warehouse employee secures compensation for back injury

Our client was a warehouse employee for a logistics company who was injured while unloading goods off a truck.

He would use a 'dolly trolley', a low platform on wheels, to load the goods and move them off out of the truck down a ramp onto the warehouse floor. On one occasion when our client was moving the trolley, it became caught in between the ramp and the floor of the delivery truck, causing him to suffer a jarred back.

Required care

As a result of the injury, our client required care from family members to assist him in carrying out basic household tasks for 12 weeks following the accident, and was absent from work for two days. He was also unable to cycle to work, as he did normally, and had to drive.

Following the accident, our client was referred to our team of specialist personal injury lawyers who investigated a claim of compensation.

It was found that the dolly trolley was unsuitable for unloading the truck and that our client should have been provided with a safer alternative. In addition, the ramp used was also unsuitable as it would not lay flush against the floor of the delivery truck. This made it more likely that trolleys would get caught in the lip. His employers admitted full liability for breaching its health and safety obligations and compensation was secured.
