Occupational disease compensation claim - Lung disease

Michelle's client in this claim for occupational disease compensation was required to clean equipment in a poorly ventilated room without proper protective equipment or adequate facilities for removing the fluid. She was required to pour it away down a sink, and because of the confined space, she had no alternative but to breathe in the vapours from the cleaning fluid with which she was provided.

At first, she did not attribute her symptoms of shortness of breath and a burning sensation in her throat to her work. However, she later became aware of the potential chemical risks she had been exposed to.

As a result of breathing in the vapours, Michelle's client had suffered damage to her throat and suffered breathing difficulties. Michelle fought this claim for occupation disease compensation on the basis that her client's employers had failed in their duty to provide her with a safe working environment, and suitable personal protective equipment for the type of work she was undertaking.

Michelle was forced to issue court proceedings when the other side refused to negotiate a settlement. However, before trial, she was able to successfully negotiate an acceptable sum in occupational disease compensation.

Road accident compensation - Passenger injured on a bus

The client in this road accident compensation claim was a minor at the time of her accident. She was a passenger on the upper deck of a bus when without warning, the bus hit the vehicle in front, causing Michelle's client to be thrown forward onto the seat in front.

Michelle's client suffered soft tissue injuries to her neck, back and lower lumbar region and was in considerable discomfort for several weeks. She also suffered sleep disturbance and some mobility problems for up to a year following the road accident.

The operators of the bus accepted liability for our client's injuries, as a result of the actions of their employee, and Michelle was able to negotiate an acceptable sum in road accident compensation for her client.

Occupiers Liability compensation claim - Slip, trip and fall in a supermarket

Michelle's client in this compensation claim had been injured whilst shopping in a high street supermarket. She was moving via the travelator from one department to another, holding the handrail with one hand. As she went to step forward, she slipped on debris and, putting out her other hand to save herself, she suffered an injury. Examination later confirmed that she had suffered a fracture and dislocation of her wrist and bruising to her elbow.

Michelle fought this claim under the Occupiers Liability Act, which requires owners of any property to ensure the safety of visitors to their premises. She argued that they had failed to keep the travelator clear of substances, and failed to have a regular cleaning system in place for the travelator.

Michelle was able to secure several thousand pounds in compensation for her client's injuries.
