Work accident compensation claim – Forklift truck injury

Working in a busy industrial environment, our client was always careful to wear his high visibility jacket, hard hat and safety boots as he made his way across the yards where forklift trucks were operating. On the day of his accident at work, he was crossing the yard when he was struck by a forklift truck engaged in unloading cargo from a wagon.

In addition to his being hit, when he fell to the ground, the driver of the truck then ran over him, causing extensive internal injuries as well as damage to his leg. As a result of this accident at work, our client had to undergo several operations and suffered permanent damage to internal organs, which have left him with on-going health problems.

Phil brought this claim for accident at work compensation on the grounds that our client’s employer had breached several regulations. In particular, they had breached Regulation 17 of the Workplace (Health, Safety & Welfare) Regulations 1992 by not ensuring that the workplace was organised so that employees could navigate the site safely.

Phil entered into extensive correspondence and detailed negotiations and was eventually able to secure over £100,000 in accident at work compensation for his client.

Work accident compensation claim– Failure to carry out risk assessments

Despite 2 separate workstation assessments that identified that alternative seating should be provided for our client, no action was taken. She was forced to continue sitting on a stool that had no back, lift the chairs when they needed to be moved (due to lack of castors) and continually twist and turn to access files due to insufficient workspace.

Despite complaints to her supervisor and the Occupational Health representative, still no action was taken, and she subsequently developed lower back pain and sciatica.

The defendant refused to negotiate a settlement and Phil was forced to issue court proceedings. However, before the date of the trial, he was able to negotiate an acceptable settlement in accident at work compensation that our client accepted.

Work accident compensation claim– manual handling injury

This client sustained a manual handling injury to his hand when helping to lift a heavy item by using a forklift truck. The object had to be lifted several feet off the ground and manoeuvred into a skip by our client. As he tried to move the item across, the forklift truck operator moved the forks, trapping his hand between them and the skip.

Several of our client’s fingers were crushed in this accident at work, and they required surgery to correct fractures. He has been left with some scarring, deformity and limited use, particularly his grip that is weaker. They remain painful, particularly when cold and frequently become swollen.

Phil brought this case on the grounds of breaches of the Workplace Regulations in that they had failed to provide a safe working environment for our client. They had also breached the Management of Health and Safety at Work Regulations in not providing adequate training to his client regarding the use of equipment such as forklift trucks.

Phil was able to secure for his client over £6,000 in accident at work compensation, although he was forced to issue court proceedings before they would negotiate an acceptable settlement.
