Successful work accident compensation claims

Work accident compensation claim – Manual handling

A nurse, our client was injured in an accident at work when a patient she was treating suddenly flipped over into the centre of the bed, pulling our client’s arms and stretching her awkwardly over the patient. Our client immediately suffered pain in her back and hip.

The patient was in a state of distress and hallucinating, and had panicked, causing the injuries to our client. Our client had been given no training or instruction in how to deal with a patient in these circumstances. No risk assessment had been carried out to assess the patient’s needs and its delivery by nursing staff.

Tony brought this case on the grounds of breaches in statutory duty due to the negligence of her employer. Despite the defendant admitting liability, Tony was forced to issue court proceedings, though he was able to negotiate a satisfactory settlement before the case went to trial. He was able to secure almost £40,000 in work accident compensation, which included a sum to recognise that the client would remain at a disadvantage in the labour market for the remainder of her working life.

Work accident compensation claim – Injured by faulty equipment

Our client was injured in a work accident when a drawer in her work area opened unexpectedly, hitting her on the knee. Management had received numerous complaints about the faulty catches on this particular type of drawer, and this specific drawer, but had failed to inspect or correct the problem.

Although she was able to continue in her job following the accident at work, she suffered considerable pain and discomfort in the first few months, and has been left with ongoing symptoms.

Her employer refused to accept liability for our client’s accident at work and Tony was forced to take the case to trial. The judge found in favour of our client and she was awarded over £5,000 in work accident compensation.

Occupational disease compensation claim - Vibration white finger

This client had worked for several employers as a labourer and had used vibrating power tools for most of his working life. During the course of his work he had used a number of vibrating tools including road breakers, whacker plates and stihl saws. None of these employers had provided our client with warnings regarding the dangers of excessive use of vibrating tools.

Our client now suffers constantly from pins and needles in his hand, made worse in cold weather and he is unable to do any work that requires the use of vibration equipment.

Although it was well known that some preventative measures could be taken to reduce the risks, none was implemented in the case of our client. There was insufficient job rotation to reduce the time spent using these tools, no adequate risk assessments were carried out which would have identified the level of risk, and no adequate protective equipment, such as gloves, were provided.

The defendants denied liability, claiming that our client’s case was time barred. However, Tony commenced court proceedings, arguing that the client was only aware of significant symptoms much more recently. The defendants eventually agreed with this close to trial and awarded our client £23,000 in compensation for his injury, which included an element of compensation for the fact that he was disadvantaged on the open labour market.
