Work accident compensation claim – Trip in pothole

Crossing the forecourt of his place of work, our client stumbled as he stepped into a pothole. Attempting to right himself, he twisted awkwardly, and in doing so suffered a twisting injury to his knee. On examination at hospital, he was found to have suffered a tearing injury that required corrective surgery. Our client was unable to return to work for several months whilst his injury healed.

The defendant’s insurers refused to negotiate an acceptable sum in settlement, despite accepting liability for his injury at work. Yvonne was forced to issue court proceedings. However, prior to the trial, Yvonne’s strong negotiating skills secured acceptable accident at work compensation, which included loss of earnings during his recuperation.

Work accident compensation claim - Assault

Our client, a care worker, was assaulted at work by a resident who was known to be aggressive towards her. The resident had received medication and should have been in his room. He attacked her from behind, causing injury to her head and neck.

Although the defendant (her employer) admitted liability, Yvonne had to enter into detailed negotiations in order to secure an acceptable sum in assault at work compensation.

Work accident compensation claim – Manual handling

Our client suffered a back injury when a patient changed her bed. Our client and colleagues had complained to management that it was difficult to provide appropriate care, but they had been told to carry on as best they could. After several days, the pain in our client’s back became unbearable and she was unable to continue working.

Yvonne fought this claim on the basis of breaches of the workplace (Health, Safety and Welfare) Regulations 1992, the Management of Health and Safety at Work Regulations 1992, and the Manual Handling Regulations 1992. The defendant admitted liability but initially offered an unacceptable level of accident at work compensation.

Yvonne continued to reject offers until the other side offered an acceptable sum. Although our client had returned to work after several weeks, she was only able to take on light duties, so her compensation included an amount for an ongoing reduction of earnings.
